Terms of Service

1. Acceptance of Terms

These Terms form a legally binding agreement between you ("you" or "User") and the operator of Luka ("we," "us," or "our"). These Terms govern your access to and use of the Luka mobile application, including all content, features, subscriptions, credits, AI story generation, narration, library, and Explore features.

We may update these Terms from time to time. Your continued use of Luka after updated Terms become effective means you accept the updated Terms.

2. Description of Service

Luka is an AI-powered story creation and listening application for iOS. Luka helps users create personalized stories, listen to AI narration, save stories and characters, continue story episodes, and explore family-friendly story content.

2.1 Third-Party AI Services

Luka does not require users to upload photos and does not collect or store users' personal photos. Luka does not perform facial recognition, face detection, or biometric analysis.

3. Eligibility and Account Security

You must be at least 13 years old or the applicable age of digital consent in your jurisdiction to create or manage an account unless a parent or legal guardian provides appropriate consent and supervision. Parents and guardians are responsible for supervising minors' use of the App.

You agree to provide accurate information, keep your account credentials secure, and promptly notify us of unauthorized account activity. You are responsible for activity that occurs under your account or device-linked account identifier.

4. Purchases, Subscriptions, and Credits

Luka may offer optional paid features, subscriptions, free trials, credits, or one-time purchases. Purchases are processed through Apple's App Store and may also be managed through subscription infrastructure such as Adapty.

• Subscription options, pricing, trial periods, credit amounts, and included features may change over time.
• Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period through your Apple App Store account settings.
• Refund requests must be submitted through Apple at reportaproblem.apple.com, unless applicable law requires otherwise.
• Excessive, automated, fraudulent, or abusive use of AI features may result in throttling, credit reversal, suspension, or termination.

5. User Content and AI Outputs

5.1 Your Inputs

You retain any rights you have in story prompts, character names, character descriptions, and other content you submit. By submitting content to Luka, you grant us a limited license to host, transmit, process, reproduce, and display that content solely as needed to provide, maintain, secure, and improve the App and enforce these Terms.

You represent that you have the rights and permissions needed to submit your content and that your content does not violate law, these Terms, or third-party rights.

5.2 AI-Generated Content

AI-generated stories, titles, summaries, narration, artwork, and other outputs may be similar or identical to outputs generated for other users. We do not guarantee that outputs are unique, accurate, complete, appropriate, or error-free. You are responsible for reviewing and deciding how to use, save, share, or publish AI-generated content.

5.3 Explore Publishing

If you publish a story to Explore, you authorize us to display, distribute, moderate, remove, and make that story available to other users inside the App. We may reject, remove, or limit visibility of Explore content at any time for safety, quality, legal, or product reasons.

6. Prohibited Content and Conduct

You agree not to use Luka to create, request, publish, or share content that:

• Is illegal, exploitative, abusive, harassing, hateful, discriminatory, or threatening.
• Contains sexually explicit content, especially any sexual content involving minors.
• Promotes self-harm, violence, dangerous activities, or instructions for wrongdoing.
• Violates privacy, publicity, copyright, trademark, or other third-party rights.
• Includes sensitive personal information that you do not have permission to use.
• Attempts to bypass safety systems, moderation, rate limits, payment systems, or security controls.

You also agree not to reverse engineer the App, scrape or automate the service, resell access, interfere with infrastructure, or use Luka in a way that harms the service or other users.

7. AI and Storytelling Disclaimer

Luka uses automated AI systems. Outputs can be fictional, inaccurate, incomplete, unexpected, or unsuitable for a particular child, family, age group, culture, or context. Luka is provided for creative, educational, and entertainment purposes only and is not a substitute for professional advice, childcare judgment, medical advice, legal advice, or parental supervision.

Parents and guardians should review generated stories and audio before allowing children to rely on or repeatedly listen to them.

8. Privacy

Your use of Luka is also governed by our Privacy Policy, which explains how we collect, use, and share information. By using Luka, you acknowledge that text prompts, story settings, character descriptions, generated story context, and related metadata may be processed by our servers and Google AI services to provide the App.

Luka does not require photo uploads, does not collect or store users' personal photos, and does not perform face recognition or biometric analysis.

9. Intellectual Property

Luka, including the App, software, design, branding, logos, features, systems, and underlying technology, is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use Luka for personal, non-commercial use in accordance with these Terms.

10. Content Moderation and Enforcement

We may use automated systems and, in limited cases, human review to detect harmful or prohibited content, investigate abuse, respond to support requests, and enforce these Terms. We may remove content, restrict features, suspend accounts, terminate access, or report illegal activity where appropriate.

11. Service Availability and Changes

We may modify, suspend, discontinue, limit, or replace any part of Luka at any time. We do not guarantee uninterrupted access, error-free operation, or permanent availability of any story, audio file, Explore listing, model, voice, subscription feature, or credit system.

12. Termination

You may stop using Luka at any time by uninstalling the App and, where available, deleting your account. We may suspend or terminate access if you violate these Terms, create risk, misuse the App, fail to pay applicable charges, or if we are required to do so by law.

Upon termination, your right to use Luka ends immediately. Certain provisions, including ownership, disclaimers, limitation of liability, indemnification, and dispute provisions, will survive termination.

13. Disclaimers

Luka is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and reliability of AI-generated outputs.

14. Limitation of Liability

To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or content. Our total liability for any claim relating to Luka will not exceed the greater of the amount you paid us in the 12 months before the claim or USD $100.

15. Indemnification

You agree to indemnify and hold us harmless from claims, damages, liabilities, losses, costs, and expenses arising from your use of Luka, your content, your AI-generated content usage, your violation of these Terms, or your violation of law or third-party rights.

16. Governing Law and Disputes

These Terms are governed by the laws of the jurisdiction in which the App operator is established, without regard to conflict of law principles. You agree to first try to resolve disputes informally by contacting us. Where permitted by law, disputes will be resolved on an individual basis and not as part of a class or representative action.

17. Apple-Specific Terms

These Terms are between you and us, not Apple. Apple is not responsible for Luka or its content. Apple has no obligation to provide maintenance or support for Luka. To the extent required by Apple's App Store terms, Apple and its subsidiaries are third-party beneficiaries of these Terms.

18. Miscellaneous

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. These Terms and the Privacy Policy are the entire agreement between you and us regarding Luka.
